The “Efrim, Roșca și Asociații” Law Firm (ERA) has expanded its consulting and litigation team by adding two attorneys and a lawyer. We’re pleased to announce that the attorneys Tinca Bodiu and Maxim Baltă, as well as the lawyer Maxim Macovei are part of ERA team.
Tinca Bodiu holds the position of Associate Attorney at ERA. She holds a Bachelor degree in Law and a LL.M. from the State University of Moldova. In 2014 she became a licentiate attorney. Tinca Bodiu previously worked in the business area, where she held the position of senior lawyer in a private company. Tinca’s areas of expertise include: commercial and civil litigations, bankruptcy, corporate law, transport and forwarding legislation and commercial mediation.
Marin Baltă is the second Associate Attorney co-opted in the ERA’s team. He holds a Bachelor degree in Law and a LL.M. from the State University of Moldova. He also holds a Bachelor degree in Economic Sciences and a MA in Corporate Finance and Insurance from the State University of Moldova. Before joining ERA’s team, Marin Baltă worked in the private field, where he held positions in economic and financial areas. Furthermore, he provided legal advice and represented the interests of clients as an Attorney. Marin’s areas of expertise include: corporate and commercial law, financial and fiscal law, labor law, investment, real estate, administrative litigation, commercial and civil litigation, mediation.
Maxim Macovei holds the position of Lawyer at ERA. He holds a Bachelor degree in Law from the State University of Moldova. Maxim Macovei is the co-founder of the European Law Student’s Association (ELSA), where he previously held the position of president. Furthermore, two consecutive years, he represented the Law Faculty of the State University of Moldova at the most prestigious Romanian contest for law students – “Hexagonul Facultăților de Drept”. Maxim’s areas of expertise include: commercial and
civil litigation, corporate and commercial law, civil law, legal due diligence.

Modificările și completările la Legea nr. 180/2008 cu privire la migrația de muncă și Legea nr. 200/2010 privind regimul străinilor în Republica Moldova au intrat în vigoare dn 06 octombrie 2017. Modificările sunt menite să optimizeze procesul de perfectare a actelor în vederea acordării/prelungirii dreptului la muncă și a dreptului de ședere provizorie în scop de muncă a străinilor angajați în Republica Moldova.

Dreptul la muncă servește temei pentru legalizarea șederii provizorii în scop de muncă a străinilor pe teritoriul Republicii Moldova. Acesta se acordă direct de către autoritatea competentă pentru ocuparea forței de muncă, iar dreptul de ședere se acordă de către autoritatea competentă pentru străini, actele fiind depuse doar la ghișeul unic al acesteia.

The Law Firm ”EFRIM, ROȘCA and Associates” (ERA) is pleased to announce the launch of the Program on Pro Bono provision of legal advice to young specialists initiating their business projects in the IT domain – “Legal Tech Start-Up”.

The Program is open to all interested and dedicated youngsters willing to be the voice of a change in the IT industry of the Republic of Moldova.

The following people are considered to be eligible provided they cumulatively meet the following requirements:

-are citizens of the Republic of Moldova;

-are aged between 18 and 35;

-have an idea of an innovative product (goods or services) in the IT business sector;

-are decided to evolve from the idea to the establishment of a business company;

-submit an application on their enrolment into the Program.

The program is also open to youngsters who have already launched a start-up, provided it is in the IT business sector and lasts for no more than 6 months.

Persons interested to apply for the participation in the Program shall submit a paper based written application (free form) at the headquarters of ERA or may sent it via email to the following address: probono@era.md.

The Program will run for a period of 6 months, starting with 6 September 2017.

The applications may be submitted throughout the Program.

The youngsters accepted in the Program will benefit from the following types of legal consultancy and assistance:

-related to the registration of their start-ups;

-while developing the documents on the establishment and functioning of their enterprise;

-with a view to improve the existing documents;

-with a view to obtain licenses, authorizations and other permits from state institutions;

-related to tax regimes, applicable tax facilities and VAT issues;

-while drafting template contracts,

-related to the process of negotiation and signing of legal acts.

ERA will not represent the beneficiaries in the courts of law in case of litigations.

More than 30 community paralegals have participated today in the first activity of the project “Strengthening the network of community paralegals” – “The opportunity of association of paralegals”. In the course of the event, it was discussed the possibility of creating an association of community paralegals, the organizational methods of a non-governmental organization, its principles of operation, as well as the modalities for accessing resources provided by donors.

The existence of a Professional Association will enhance the capacities of advocacy of the paralegals’ network, indispensable for the development of the paralegals’ institution, and its affirmation as a reliable partner of the National Council for State Guaranteed Legal Assistance (NCSGLA). At the same time, will offer more visibility to the positive impact generated by the free services provided by paralegals within the rural communities.

“Through this project we wish to contribute to the development of the paralegals’ network. To offer assistance needed within the process of association, to help to facilitate communication with public authorities, to stay side by side with you in the courts and to support you in various cases. Together we can identify the best solutions for your beneficiaries”, has underlined the coordinator of the Bar Association of Lawyers “Efrim, Rosca & Associates”, Oleg Efrim.

Representation of Soros-Moldova Foundation, Natalia Camburian, has mentioned that Soros-Moldova Foundation is ready to provide to paralegals the aid needed. “We support you and we will continue to provide you not only financial support, but also the assistance needed for the creation and development of an Association of Paralegals. If there’s anything you need, don’t hesitate to ask.”, has declared Natalia Camburian.

Vladimir Palamarciuc, member of the Board of the Young Lawyers Association, have related to participants about the experiences the members of Association have gone through at its founding, the steps they have taken and how they managed to assert themselves on the advocacy market. “The creation of an association will bring benefits not only to paralegals, but to the entire system as well. Will allow you to develop individual projects as well as projects of professional support to members of the Association”, has reiterated Vladimir Palamarciuc.

Present at the event, Daniela Vidaicu, the national coordinator of programs of the Embassy of Sweden, has encouraged the paralegals to create an association, because in this way they will be able to achieve bigger results. “The creation of the network of paralegals is a success. Now comes another stage of coagulation, a stage in which you should continue doing good things further. We support you and we urge you to continue making useful things for the society. The donors support good and strong initiatives. Together is easier to obtain visible results, alone is much harder.”, said Daniela Vidaicu.

In the event, head of the Division of non-commercial organizations of the Ministry of Justice, Alexandrina Culcitchi, has related to paralegals about the organizational methods of a non-governmental organization, the legislative provisions, acts needed for the creation of an association. Paralegals present at the event expressed their interest towards the possibility of association and means of accessing financial resources.

The project “Strengthening the network of paralegals” is implemented by the Bar Association of Lawyers “Efrim, Rosca & Associates” and is co-financed by the Legal Program of Soros-Moldova Foundation. The project’s goal is to strengthen the network of paralegals through the creation of a National Association of Paralegals from Moldova.
The network of paralegals was created in 2010. During this time, with the help of paralegals, thousands of people have managed to solve their legal problems faced by them, whether it was about inheritance, divorce, social assistance or right to property.

Soros Foundation-Moldova and Law Firm “Efrim, Rosca and Associates” (ERA) launches the joint project “Strengthening the Network of Community Paralegals”. This project aims to improve the professional skills of paralegals through their association and promoting culture of pro bono services provided by lawyers in cases of strategic litigation identified by paralegals.

Currently, the network of paralegals is facing problems of financial stability and sustainability. State budget resources allocated for the network are insufficient to cover their needs for continuous training in various specific areas of interest for beneficiaries in the community. Also, network members mostly did not know each other and do not have any forum for direct communication that would enable them to identify solutions to concrete cases and issues. The current situation requires them to overcome their problems individually as far as possible, which leads to frequent mistakes.

Therefore, the project “Strengthening the Network of Community Paralegals” will focus on the following:
• developing associative culture and providing technical support to the professional association of paralegals;
• development of professional skills of paralegals in consultation on specific cases (back-up lawyers);
• strategic pro bono litigation on cases taken from para-lawyers;
• promoting pro bono culture and mechanisms in the professional environment of lawyers.

The project “Strengthening the Network of Community Paralegals” intends to strengthen the network of paralegals by creating a National Association of Paralegals in Moldova. Existence of a Professional Association will increase the advocacy capabilities of the network of paralegals, needed for the development of the institution of paralegals and its affirmation as a reliable partner of the National Legal Aid Council of State (CNAJGS). It will also give more visibility to the positive impact generated by the services provided free of charge by paralegals in rural communities.

In this project, ERA will focus on involving paralegals in defending and promoting their corporate interests and will contribute to improving the capabilities of legal empowerment of paralegals on specific areas, promoting pro bono legal assistance as a form of legal services provided by lawyers, decreasing discrimination against various marginalized groups as a result of strategic disputes.

The project duration is 11 months. During this period, trainings for paralegals will be organized on specific areas; necessary assistance will be provided in the process of association; communication will be facilitated with public authorities; will be ensured representation in court of beneficiaries of paralegals. Likewise, the regulatory framework and the relevant judicial practice will be analyzed and public policy proposals will be developed etc.

Moreover, ERA shall through strategic litigation attract more supporters for cases they will litigate and therefore will influence the relevant / concerned state authorities to take necessary measures to improve the legal and institutional framework or practices existing in addressing certain issues regarding human rights.

However, a mentoring program will be created for paralegals from a group of licensed lawyers. Thus, para-lawyers will be trained on specific topics depending on the needs of particular groups of beneficiaries (eg .: drug users HIV / AIDS, Romani people, commercial sex workers, etc.); newsletters on specific themes will be drawn up; online and in real time interaction will be ensured between paralegals and a group of licensed lawyers.

The network of Paralegals was created in 2010. During this time, thousands of people succeeded with paralegals to resolve legal issues that have faced, whether it was about inheritance, divorce, social support or property rights.
